Wills in Turkey

This subject crops up regularly.

Some people say Turkish inheritance Laws always take precedence over written wills that attempt to disinherit children, regarding immovable property in Turkey.

Other people have found lawyers who claim to be able to write such a will that will be accepted by the courts, but, as far as I know, without it having been put to the test.

Does anyone have first hand experience of a will being accepted by the courts that did not comply with Turkish inheritance laws regarding immovable property in Turkey?

Many thanks.

David

No first hand experience of acceptability, but when we bought in Bodrum several years ago, I raised the question, with my lawyer, of the need for a Turkish will to cover the transfer of all assets to our UK benefactors.
At this stage he could have told me that I needed a Turkish will, at whatever price he decided. However, he said that as long as I was UK resident and had a UK will, all he would require in the event of death was an authorised copy of the UK will and of UK Probate, at which time my wishes could be carried out.
As I say, I have no proof that this will stand up in Turkey - time will tell.

Re: Wills in Turkey

Have had first hand experience of several cases and in each case the court applied the Turkish law of inheritance and some years ago the British Consular representative came to Alanya to address this topic and stated she had never come across a case where this did not happen.

Re: Wills in Turkey

There is a longstanding member on here who dealt with someone (Brit) who died in Turkey without a Will.................it was a nightmare for them. They done it as a neighbour & to help the sons who lived in the UK. It also involved a brand new car that sat outside the guys apartment for nearly two years after his death. Numerous trips from Didm to Izmir, various accumulated paperwork from the UK, two sons doing two or three trips............they would not do it again.

RIP Jim from Mavisehir.
