It is one of these things that will only be clear after the current owner's death.

That is why I have my doubt and said I would try to find info for her.
The mother will not be gifting the house as I undertand it. The daughter will be buying a share. Turkish Law can be tricky.

And to be fair, the value of the house as valued by the belediye (?) is a lot lower than what it would be if put on the market. We bought ours for 80,000 yet at todays rate of exchange it is valued at 35,000 on the tapu. Xx

Very surprised someone received this advice. It is in a very specialised aspect of usufrucht law. Usufrucht law is very rarely used by the common person in Turkey, and is generally 'unheard of', but is valid. However it is so specialised that it is very surpising that a simple outfit like YellAli is offering this advice, and written by a foreigner no less. Read it but do not rely on it. For the application of this law, obtaining legal advice from a higher echelon corporate law firm is advisable; either in Ankara or Istanbul. Relying on a local coastal lawyer is a stretch too far. The advice, and implementation, will be actionable, but may also require additional legal services if a challenge from the Turkish tax authorities materialises post probate. Likewise for UK or Country of Residence Tax claims, which liabilities are quite possibky impossible to ascertainin advance.

She has been to a lawyer. Says it is possible. Daughter to be given 35% of share on tapu. Awaiting update.
