AGM concerns

Hello.
It will soon be time for our AGM. I have two concerns which I am sure are illegal.
One of the owners has said he will act as interpreter at the meeting to save on costs. I am concerned the translation may not be accurate. Is it not law that we need a registered translator?
There will be a maintenance budget put to all owners but we will not be given the opportunity to vote on it. I understood all owners were to be allowed to vote.
I believe some owners will not accept the budget. Will it still be passed as majority vote or do all have to agree?

Hello Ian.
I will not be at the meeting but if I were that would mean I would be paying the full price for the interpreter. I am checking the legal side.

The site fees need to be set,I previously used to present estimates to the meeting and all owners voted in the whole package.
If the owners requirements where for improvements to facilities the estimates for the work where presented and voted on .
A simple majority is required barring for changing the management plan.
We took a proactive approach issuing 4 newsletters a year asking owners for suggestions and presenting them at the annual meeting for decision.

There is no legal requirement for an interpreter and owners will approve or reject the budget by a simple majority of the AGM.

As others have said there is no legal requirement to have an translator or interpreter at the AGM. That said, as this is Turkey, the record for the meeting is legally recoded and registered in Turkish - so the translator & interpreter is for the benefit of non-Turkish speakers.

We usually have a couple of people translating and interpreting - to ensure that we have the benefit of both translation & interpretation (separate issues). We never pay for this - but use local friends.

The meeting is of course governed by the TCL (Turkish Condominium law) criteria, which set out the clear requirements.

Of note, for the meeting to be quorate it must have 50%+1 Owner present or represented. If not quorate the AGM meeting should be immediately suspended and a further date set, with at least one weeks notice, where then a simple majority is used.

The Maintenance (and if appropriate Management) budget should of course be discussed and agreed at each AGM (and if appropriate EGM). The required list includes as a legal minimum:-

1. Receive an annual report from the Controller Board

2. Receive an annual report, including finance report from the Sitesi Manager

3. Elect and appoint a Controller Board

4. Elect and appoint a Sitesi Manager

5. Consider Control Board sponsored proposals

6. Consider Homeowner sponsored proposals

I have attended a number of meetings before but these two issues are being pushed by one owner. Just wanted to see where we stood legally on these. Thanks for all replies.
