Freehold title deed

How do you know if your Tapu is Freehold.

Is there any way to establish if the Developer holds the right to the land your property is built upon.

You need to check to see what the TAPU is for, could be for land only (even agriculture land in some cases) also you can check if there are any debts on the property, all this can be verified from the TAPU office.

I think its something to do with the word arsa on the Tapu ? i am not sure if that just means that the person who,s name is on the tapu just owns the land .?

you need to be a little carefull in translation as the plot of land used for the construction is shown on the Tapu as "arsa". If you search there is a whole translation of the Tapu placed on the forum by another member.

As i said i am not sure ,but also as someone else said i think it is freehold only in Turkey . I know my Tapu has the building on it [obviously all in Turkish ] ans some tapus have land only on them ,and there have been some problems with that especially whjen there is a building on it and it only states land . Its like this irtifaki mulkiyeti palaver ,no one seemed to know about it 5 years ago when they [ and me ] got their tapu . But now everyone seems to know what that means .

I believe if you Kat Irtifakti marked with an X that means you own the Land and Building but not allowed to live in it (as we did)
You really need Kat Mulkiyeti box marked with X that means you own everything and have the Habbitation Certificate.

Thank you for your replies, I am sure you are wondering why I possed the question.

I am in contact with other owners on a number of complex's around the Bodrum area, comparing Management Plans and trying to help each other. My ultimate goal would be to have all management plans brought into line with Turkish Condo Law and to reflect the real meaning of what a management plan should reflect and not as a means for Developers to make money and control for selfish interests.

Here is an example of what a friend is faced with on his complex.

All individual property owners shall, upon acquiring the titles to the properties, accept in advance that the main land owner Signature Resorts (“SR”) has appointed Signature Resorts Management (“SRM”) to have the exclusive right and privilege to manage the Resort for at least a period of 2 (two) years from the completion of Phase.

He might as well hand them his money and his keys and just show up now and then to have a holiday.

I was also looking at the wording in the Sales Information on FLAMINGO GOLF RESORT and it states all properties are FREEHOLD which leads me to believe not all complex's are freehold. Basically...me thinks, I own my property but not the land as my garden is referred to as communal land.
