Dear fellow homeowners,
I want to share some of my thoughts on the recent furore surrounding our site and its illegal management. First and foremost we want our legal right to choose our site management company, a right denied to us by Artev’s illegal clause, in which they reserve the right to choose the management company for the first 5 years. Regardless of any of our personal feelings towards VT or the job they are doing, we should have the right to choose to stay with them or appoint someone new, this is our democratic right and it’s worth fighting for. I personally feel that any management company, including VT, would provide a better level of customer service if they answered directly to us as homeowners. It makes sense as we as homeowners would ultimately decide their fate when it comes to contract renewal, we would also get final say on all big decisions regarding how our money is spent, instead of finding out months later. In my opinion you can’t serve two masters, and I feel VT have spent too long serving the needs of Artev and those of the VT board at the expense of our needs as homeowners. At the end of the 5 years, in 2013 both Artev and VT will walk away from Turquoise with their pockets full of our money and a 5 year building guarantee which will have expired, having never been used to properly correct all the known faults around the site, which will then haunt us for years to come.

Secondly I’d like to say to all of the homeowners who don’t wish to upset the apple cart because VT rents out your property, providing you with an income. Think again. Over the winter Artev and VT have furnished literally hundreds of Artev’s empty properties across the 3 sites, particularly on FCC. They have done this with the intention of renting them out, and if you think that VT are going to rent your property out before every last one of those properties is let, you’ve got another thing coming. This is going to effect all your rental incomes this year, its simple supply and demand, and the supply of rental properties just doubled!

Next I’d like to briefly comment on a couple of prominent homeowners, who until recently vowed to fight VT until their dying breath and who now seem rather smitten with our site managers. It all strikes me as rather strange and if I didn’t know better, I would think that 30 pieces of silver were involved.

Finally I’d like to say please don’t get sucked in by a fixed rate electricity charge, a few dead palm trees and some steps into the pool. Remember that’s not much to show for 3 years of work and hundreds of thousands of pounds. Artev and VT are worried and will try anything to pull the wool over our eyes, this now includes trying to rebrand our site management company! Apparently, we no longer have VT as our management company, but have ‘Turquoise Site Management’ instead. If this is a whole new company, then when did we vote on this and who do they report to, if not VT? If it’s not a brand new company, then what we have is the same staff with the same ways of working and a new name. Thanks for reading.

Who are you? This is your first post and you say nothing about yourself. If you were a Turquoise homeowner surely you would have sent this to the other owners or put it on the Turquoise Owners forum rather than post it on a public forum for all to see. There have been too many one-posters on here who try to stir things up then disappear off the face of the earth once challenged.

Hi Tillyfloss, I am a turquoise home owner who wishes to remain anonymous. Some home owners have bravely come out and spoken their mind against VT and have been harassed every time they visit the site. Well I'm sorry but I'm not that brave, I have to think of my family and do not want our holidays spoilt by VT's bullyboy tactics. This post is my way of communicating my feelings to fellow turquoise home owners and if you were one of them then you might understand our frustrations.

I am a Turquoise homeowner and therefore know that there are other ways of communicating than posting your problems on a public forum which will only serve to build up a bad reputation for Turquoise when it is in fact a lovely site with many happy owners.

Then you will also understand it is impossible to remain anonymous by posting on the owners website. Turquoise is a lovely site, but this is inspite of VT, not because of it. I'm sorry my views have upset you, but I feel with all that is happening at the moment that I could no longer remain silent. I'm sure none of us want bad publicity for our site, but we risk far more by saying nothing and allowing these people to treat us anyway they choose.

seems a shame to be locked in for 5 years as i know normal site rules are that the builder runs the site for 6 months & then the owners form a commitee & appoint their own management co ,sfter inviting tenders .

I guess in the so said ''yonetim plan'' which is the original management plan registered at the deed office, the builder has given his self the power to manage or let manage the complex.

This is a common way, especially if the builder will benefit from the complex. There is notthing you can do. Biggles, your comment is wrong in this case.

But, because the builder did put this term in the original management plan doesnt mean this is forever. You can change the management plan, and cancel the 5 years agreement regardless managemet company. To do so you needed in 2010 all owners agreement for any change. But since 2011, you need only 4/5 of the owners for to re-design of the management plan. See original text regarding new owners act!!


B) Management plan
ARTICLE 28. – The management plan shall determine the method of management, the object and manner of use, the remuneration of managers and controllers and other details regarding management. The management plan has the force of an agreement binding on all condominium owners.
In the absence of any provisions in the management plan, disputes arising from the management of the main property shall be settled according to this law and to general legislation.

(Amended: 13/4/1983 - 2814/art 11.) The votes of four fifth of condominium owners are required for any modification in the management plan. The right of condominium owners to apply to the court according to article 33 is reserved.

The management plan and amendments thereof shall be binding on all condominium owners and their heirs and general legatees and their managers and controllers.

The date of the management plan and of all subsequent amendments shall be entered in the column entitled “statements” of the condominium ownership log and they shall be attached to the management plan and kept with the documents regarding the establishment of condominium ownership.

I can only recommend to use a good lawyer specialised in community law. If you need one I can recommend to you a good one. He helped us out of the same situation with a similar builder trying to play games with owners.

Hi Emerald, I don't know who Adrian is, and can only assume that your intention is to discredit me and my views by suggesting this as my identity. So out of interest I have read through all your previous posts and I have found that I'm the 5th person you have accused of being Adrian Jackson this year. Whilst I can't comment on the identity of the other 4, I can assure you that I am a concerned Turquoise homeowner, who feels that we should have our legal right to choose our own management company. It suprises me that any homeowner wouldn't feel same.

Hello all, I am a very happy home owner in Turquoise, and Turquoise has never looked better. The Turquoise Site Management is looking out for its home owners, and also the VT management looks out for the home owners. In fact the day before yesterday I witnessed a horrible event in Turquoise where someone attacked some people who work for VT and for Turquoise, later I found out why this event took place, it was all about a non-paying long term renter who attacked VT because they were trying to get the home owner payed his rents and other debts. The VT persons did not get involved in this for ARTEV or for themselves. They got involved for a home owner, which they didnt have to do, as the home owner could have used a sollicitor to try to get payed through legal ways or at least get rid of this renter. I think this shows VT's and the Turquoise management's loyalty to the home owners.
Im really fed up with all the negative emails which I receive, and I have put them in SPAM, because it irritates me enormously.
I own a beautiful house in a beautiful site and I can see everybody working there doing their very best.
So I suggest for every other home owner to enjoy their property and see the good in everything instead of being negative. This is aspecially to you Turquoise Cat.
